Copyright & DMCA Policy

Our position on copyright

Hubfolio Digital Marketing Ltd. respects intellectual property rights and expects the same from clients and third parties. We license every stock image, font, plugin and library we use, and we do not knowingly reproduce anyone’s copyrighted material without permission.

We respond to properly made infringement notices concerning this website and any website we host or manage, in accordance with Canadian copyright law and, where applicable, the United States Digital Millennium Copyright Act.

Canadian notice-and-notice

Under Canada’s Copyright Act, a host or service provider that receives a compliant notice of claimed infringement is required to forward it to the relevant subscriber and retain records. We comply with that regime for content on systems we manage. Canadian notice-and-notice does not itself require removal of content; where we also fall within the scope of the DMCA, the takedown process below applies.

Filing an infringement notice

Send a written notice to info@hubfoliodigital.ca with the subject line "Copyright Notice". To be actionable, it must include all of the following:

• Your name, address, telephone number and email address
• Identification of the copyrighted work you claim has been infringed
• The exact location (URL) of the material you claim is infringing, specific enough for us to locate it
• A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law
• A statement that the information in the notice is accurate, and — under penalty of perjury where the DMCA applies — that you are the owner or authorised to act on the owner’s behalf
• Your physical or electronic signature

Incomplete notices cannot be acted on. We will tell you what is missing.

What happens next

Filing a counter-notice

If your material was removed and you believe that was a mistake or misidentification, send a counter-notice to info@hubfoliodigital.ca containing:

• Your name, address, telephone number and email address
• Identification of the material removed and the location it appeared before removal
• A statement, under penalty of perjury where applicable, that you have a good-faith belief the material was removed as a result of mistake or misidentification
• Consent to the jurisdiction of the appropriate court, and agreement to accept service of process from the complaining party
• Your physical or electronic signature

Repeat infringers

We terminate services to clients or subscribers who are repeat infringers, and we may decline to produce or publish material where we have reasonable grounds to believe it infringes a third party’s rights.

Client-supplied material

Where you supply images, text, video, music, fonts or other material for us to use, you confirm that you hold the necessary rights or licences. We are not able to verify the provenance of client-supplied material, and under our Terms & Conditions you indemnify us against claims arising from it.

If you are unsure whether you have the right to use something, tell us before we build it in. Replacing infringing material after launch is always more expensive than licensing it correctly beforehand.

The text, design, code, diagrams and images on this website are the property of Hubfolio Digital Marketing Ltd. and are protected by copyright. You may not reproduce, republish or adapt substantial portions without written permission. Ordinary quoting with attribution and a link is fine.

Misrepresentation

Knowingly making a material misrepresentation in a copyright notice or counter-notice may expose you to liability for damages, including costs and legal fees. Please be certain before filing.
