Confidentiality & NDA Policy
How we handle your commercially sensitive information, the access we take to your systems, and the mutual non-disclosure terms we work under.

Our standing commitment
Marketing work requires access to information most businesses would not share publicly: pricing and margins, customer lists, supplier arrangements, enquiry volumes, conversion rates, advertising performance, and the strategic plans behind all of it.
We treat that information as confidential by default, from the first conversation, whether or not a separate non-disclosure agreement has been signed. You do not need to ask us for confidentiality — it applies to every enquiry, every quote and every engagement.
What we treat as confidential
- Financial information — pricing, margins, revenue, budgets and customer value
- Customer and supplier lists and any personal information within them
- Enquiry, conversion and performance data from your accounts
- Strategy, plans, launches and anything not yet public
- Credentials, access tokens and account configurations
- The existence and content of quotes, proposals and negotiations
- Anything you tell us is confidential, or that a reasonable person would treat as confidential
What is not confidential
- Information already public, or that becomes public other than through our breach
- Information we already held before you disclosed it, without a duty of confidence
- Information lawfully received from a third party free to disclose it
- Information independently developed by us without using yours
- General skills, know-how and experience we acquire in the ordinary course of our work
How we protect it
- Access limited to the individuals who need it to perform the work
- Multi-factor authentication on every platform that supports it
- Credentials held in an encrypted password manager, never in email, chat or spreadsheets
- Encrypted devices, kept current with security updates
- Client files kept in separate, access-controlled storage rather than a shared pool
- Subcontractors, where used, bound by written confidentiality obligations no less protective than these
- Access revoked promptly at the end of an engagement, and confirmed to you in writing on request
Access to your accounts
Where you grant us access to advertising, analytics, hosting, website or business platforms, that access is used solely to deliver the agreed services. We do not export data for purposes unconnected with your engagement, we do not use your account data to inform work for another client, and we do not transfer ownership of your accounts to ourselves.
Accounts are created in your business name wherever the platform permits, with you retaining administrator rights throughout. At the end of an engagement we remove our own access on request and confirm when it has been removed.
Competing clients
We do not act for two directly competing businesses in the same category and service area at the same time. Where a potential conflict arises, we will raise it before accepting the work and, if necessary, decline the engagement.
We do not use one client’s confidential information — including their performance data, keyword strategy or pricing — in work for anyone else. General expertise gained through experience is ours; your specific information is not.
Portfolio and references
We may wish to reference an engagement or display non-confidential work in our portfolio. Where the work is publicly visible in any case — a live website, published artwork, a public advertisement — we treat display as permitted unless you ask us in writing not to. Performance figures, internal documents and anything you have marked confidential are never published without your specific written consent.
Signing an NDA
We are happy to sign your non-disclosure agreement, and we will do so without negotiation where the terms are reasonable and mutual. If you would prefer to use ours, the mutual terms below are what we offer.

Mutual non-disclosure — standard terms
The following summarises the mutual NDA we work under. It is provided so you can see our position before asking for a copy.

Personal information
Where confidential information includes personal information about identifiable individuals, our Privacy Policy applies in addition to this policy, and the stricter obligation prevails.
Reporting a concern
If you believe confidential information has been mishandled, contact info@hubfoliodigital.ca immediately. We will investigate, tell you what we find, and where a breach has occurred we will notify you without undue delay so you can meet your own obligations.
